Terms of Use Agreement

Welcome to the South Bay Energy $avings Center Vendor Database (“Database”).  By clicking “I Agree” and using, registering or otherwise entering information into the “Database” you are agreeing to comply with and be found by the following Terms of Use.  Please read them carefully.  If you do not agree to these terms, you must not use, register or otherwise enter information into the Database.  The term “SBE$C/SBCCOG” or “us” or “we” or “our” refers to South Bay Energy $avings Center and the South Bay Cities Council of Governments, the owner of the Database and this website.  The term “Vendor”, “you” or “your” refers to the company, organization, entity or person using, registering or providing information for inclusion in the Database.

1. Changes in Terms and Conditions

This Agreement may be amended or modified at any time by us from time to time without specific notice to you.  The latest Agreement will be posted on the Site and you should review this Agreement periodically.

2.  Accuracy of Information

Any and all information provided by you will be accurate to the best of your knowledge and you are solely responsible for such content.  You are encouraged to regularly maintain and update your records so that database users are not referring to inaccurate or outdated information.  SBE$C/SBCCOG will not edit or modify your data except as may be necessary for proper browser rendering.

United States and foreign copyright laws and international conventions protect the contents of the Site.  You agree to abide by all copyright laws and notices.

3. No Right to Inclusion; No Implied Endorsement

SBE$C/SBCCOG reserves the right to include or exclude your information from public viewing for any reason whatsoever.  Inclusion in the Database does not constitute or imply any endorsement by SBE$C/SBCCOG of the companies, products, services and/or other information supplied.


4. No Support; No Agency Relationship

Neither SBE$C/SBCCOG or its representatives, agents or affiliates will answer questions about or provide support for the information or data supplied by you.  SBE$C/SBCCOG will not represent or act as your agent or affiliate.

5. Notices

You agree to receive required administrative and legal notices electronically from time to time as may be necessary to maintain the Database.


6. Disclaimer of Warranty

You expressly understand and agree that your use of the Site is at your own risk.  Neither the SBE$C/SBCCOG nor its employees warrant that the Site will be uninterrupted, problem-free, free of omissions, or error-free; nor do they make any warranty as to the results that may be obtained from the use of the Site.  The content and function of the Site are provided to you “as is,” without warranties of any kind, either express or implied, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose or use, or “currentness.”

7. Limitation of Liability

In no event will the SBE$C/SBCCOG or its staff be liable for any incidental, indirect, special, punitive, exemplary, or consequential damages, arising out of your use of or inability to use the Site, including without limitation, loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction, or any and all other damages.
